These Terms of Service ("Terms") are an agreement between you and Synthesize360, LLC, a Florida limited liability company ("we", "us", "our"), governing your use of Market Fusion IQ (the "Service"), available at marketfusion.io and through the Market Fusion IQ iOS application.
By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use the Service. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@synthesize360.com if you suspect unauthorized access. You agree to provide accurate information when registering and to keep your account information current.
Market Fusion IQ is an educational platform that provides market data, technical analysis, automated trading signals, AI-generated analyst commentary, and related tools to help users learn about and evaluate financial markets. The Service is designed to support your own research; it is not a brokerage, an investment manager, or a financial advisor.
Market data may be delayed, incomplete, or incorrect. Signals, indicators, and analyst output are generated algorithmically and may contain errors. You must independently verify any information before acting on it.
The Service does not provide financial, investment, legal, tax, or accounting advice. Synthesize360, LLC is not a registered investment adviser, broker-dealer, or financial planner. Nothing on the Service — including signals, recommendations, scores, ratings, AI analyst commentary, or backtest results — is personalized investment advice or a solicitation to buy or sell any security.
Trading and investing involve substantial risk, including the potential total loss of capital. Past performance does not guarantee future results. Leveraged products amplify both gains and losses. International, options, and cryptocurrency markets carry additional risk. Algorithmic outputs can be wrong. You are solely responsible for your investment decisions and outcomes.

The Service is offered in free and paid subscription tiers.
Apple In-App Purchase (iOS). iOS subscriptions are processed by Apple. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings. No refunds are issued for unused portions of a billing period; refund requests for Apple-billed purchases must be submitted to Apple.
Stripe (web). Web subscriptions are processed by Stripe. Payment is charged to the payment method on file at confirmation of purchase. Subscriptions automatically renew at the end of each billing period unless cancelled. You can cancel anytime through your account settings; cancellation takes effect at the end of the current billing period. No refunds are issued for unused portions of a billing period.
Tier changes. Upgrades take effect immediately and are prorated where supported by the processor. Downgrades take effect at the end of the current billing period.
Pricing and feature changes. We may change prices, features, or tier definitions on prospective notice (email or in-Service notice at least 30 days in advance for paid tiers). Continued use of a paid subscription after the change takes effect constitutes acceptance.
The Service lets you create and store content, including custom strategies, watchlists, alert preferences, and notes ("User Content").
You retain ownership of your User Content. You grant Synthesize360, LLC a non-exclusive, royalty-free, worldwide license to host, store, display, and process your User Content as necessary to operate the Service for you, including transmitting limited User Content (such as the names of custom strategies) to third-party AI providers as described in our Privacy Policy.
You represent that your User Content does not infringe any third party's rights and does not violate these Terms or any law. We may remove User Content that we believe violates these Terms.
You agree to use the Service only for lawful, personal purposes consistent with these Terms. You will not:
The Service, including all software, algorithms, signal logic, AI prompts, content compilations, designs, logos, and trademarks, is owned by Synthesize360, LLC or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial use in accordance with these Terms. All other rights are reserved.
If you believe content on the Service infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c)(3) (the Digital Millennium Copyright Act) to:

Counter-notices may be sent to the same address. We may terminate the accounts of repeat infringers.
The Service integrates with third-party providers (including Apple, Stripe, Anthropic, and Firebase Cloud Messaging) and may include links to third-party websites and content. These third-party services are governed by their own terms and privacy policies; we are not responsible for their content, availability, or practices. Your use of third-party services is at your own risk.
The following terms apply when you use the Service through the Market Fusion IQ iOS application obtained from Apple's App Store:
Disclaimers. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR UNINTERRUPTED OPERATION. We do not guarantee that the Service will be free of errors, defects, delays, or security incidents. No fiduciary relationship is created between you and Synthesize360, LLC by your use of the Service.
Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYNTHESIZE360, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR INVESTMENT LOSSES, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
Indemnification. You agree to defend, indemnify, and hold harmless Synthesize360, LLC and its officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your User Content, or your misuse of the Service.
We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or created risk for us or other users. We may also discontinue the Service in whole or in part at any time on reasonable notice.
You may terminate your account at any time by contacting legal@synthesize360.com. Account deletion is processed as described in our Privacy Policy.
Sections that by their nature should survive termination — including Sections 5 (User Content license), 6 (Acceptable Use), 7 (Intellectual Property), 10 (Disclaimers; Limitation of Liability; Indemnification), 12 (Governing Law), and 13 (General) — survive any termination of these Terms or your account.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will be conducted in Pinellas County, Florida, or by remote videoconference at your election. Judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver. You and Synthesize360, LLC each waive any right to bring claims as a class, collective, or representative action. Disputes will be resolved only on an individual basis.
Exception. Either party may bring an individual action for small-claims-court relief or seek injunctive relief in court for actual or threatened infringement, misappropriation, or violation of intellectual-property rights, without first proceeding to arbitration.
Privacy. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Modifications. We may update these Terms from time to time. If we make material changes, we will notify you by email or by prominent notice in the Service before they take effect. The "Last Updated" date at the top reflects the most recent revision. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
Entire Agreement. These Terms, together with the Privacy Policy and (where applicable) Apple's and Stripe's terms governing your purchase, constitute the entire agreement between you and Synthesize360, LLC regarding the Service and supersede all prior agreements.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be replaced by an enforceable provision that most closely reflects the original intent.
No waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

BY USING MARKET FUSION IQ, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS, AGREE TO BE BOUND BY THEM, AND ACKNOWLEDGE THAT TRADING AND INVESTING INVOLVE SUBSTANTIAL RISK OF LOSS AND ARE NOT SUITABLE FOR ALL INVESTORS.
